6. Additional terms and conditions for providing travel insurance services during flight booking ("Platform")
6.1 Non-discriminatory and fair treatment of products, services, or materials
THAI respects and commits to providing equal and fair trade. THAI does not treat products, services, or content differently on the Platform.
6.2 Advertising
As the Platform aims to offer you travel insurance services primarily for your safety, THAI does not present any advertisements on the Platform. If THAI intends to present any advertisements on the Platform, THAI will publish further information on the Platform, and/or announce additional terms and conditions of services.
6.3 Other channels for offering products, services, or content
THAI does not offer any of the products, services, or content on the Platform through any other distribution channels.

6.4 Ancillary products, services, or content
THAI does not offer any ancillary products, services, or content, or those products, services, or content used in conjunction with primary products, services, or content offered by THAI or third parties. If THAI intends to offer any ancillary products, services, or content, THAI will publish further information on its website, and/or announce additional terms and conditions of services.
6.5 Fair competition
To provide Platform services, THAI imposes no conditions to restrict or prevent service users from offering the same types of products, services, or content through other channels.
6.6 Temporary suspension or termination of services
(a) If THAI intends to temporarily suspend provision of its Platform services to you, whether in part or in whole, THAI will notify you a written notice before or while suspending the provision of services, together with reasons for the temporary suspension as required by law.
(b) If THAI intends to terminate the delivery of Platform services to you, whether in part or in whole, THAI will notify you a written notice at least 30 days in advance of the termination of services, together with reasons for the termination as required by law, unless the termination is performed in line with a law or legal order, causing THAI to be unable to notify you a notice within such specified period, or the termination is resulted from your repeated breach of any terms of service in the same matter, or the termination is a result of any of the serious violations prescribed in section 6.6 c).
(c) THAI hereby reserves its right to terminate the provision of services immediately, without the need to notify you an advance notice, if it has reasonable grounds to believe, or is informed that you perform any of the following serious violations:
1) You violate any of these terms of use, including other applicable terms of THAI;
2) You infringe the intellectual property of any third party;
3) You take any action that violates applicable laws or causes THAI to violate or fail to comply with relevant laws;
4) You commit fraud or take any action indicating fraudulent intent regarding your use of Platform;
5) You take any action that unreasonably disturbs or affects THAI's system, or its provision of Platform services, or other service users' use of the services, at THAI's discretion; or
(d) If you are notified of a temporary suspension or termination of services, you can clarify the facts and reasons with THAI, through the channels and procedures prescribed in section 6.10, within 30 days after receiving the notice.
(e) If THAI cancels a temporary suspension or termination of services, THAI will reinstate your service status within a reasonable period of time. You can access your personal data or other information that you have on the Platform before the temporary suspension or termination of services.
(f) If THAI needs a temporary suspension to improve its provision of services, or if there is any problem or deficiency in services, or other similar causes, any of the following terms will be applied.
1) For a temporary suspension that has been prepared in advance, THAI will notify you an advance notice before the suspension, including details regarding reasons and a period of suspension.
2) If a temporary suspension of services is considered an emergency (without preparation in advance), THAI will notify you a notice as soon as possible after the suspension, including details regarding the reasons, period of suspension, or expected duration.
6.7 Identity verification and authentication for service users
For flight booking, THAI has to carry out an identity verification process by asking you to fill in personal information as required by the Platform, such as your first name and last name, telephone number, and email address. The personal information you fill in must be true, accurate and current, and contact information must be the contact that is still available for communication only. This is to allow THAI to verify your identity for the purpose of purchasing products and services, and/or to allow you to redeem special privileges.
6.8 Opinions of service users
THAI places importance on your opinions and is committed to providing you with the best customer experience. Although THAI may have no specific review functions available on the Platform to measure customer satisfaction or receive your service reviews, you can express comments or suggestions by contacting THAI via the channels listed in section 6.10.
6.9 Ranking or recommending products, services, or content
THAI does not provide rankings or recommendations on lists of products, services, computer data, advertisements, customer satisfaction evaluation and service reviews, or other content on the Platform.
6.10 Assistance, complaint management, and dispute resolution
(a) If you have any questions or need any help, you may contact THAI at https://www.thaiairways.com/th_TH/contact_us/index.page?
(b) Upon receipt of your complaint, THAI will respond to you within 30 days after receiving the complaints. THAI will consider and investigate the complaint, and coordinate with the relevant persons to take further action. This may include problem solving, negotiations to resolve any arising disputes, and providing any remedies (if any). THAI will inform you of follow-up channels and results of the actions.
(c) You can make complaint via the Electronic Transaction Development Agency (ETDA)'s Online Help and Problem Management Center (1212ETDA) at hotline 1212 (24 hours) and via email: 1212@mdes.go.th. However, THAI respectfully asks that you give THAI an opportunity to address your concerns before you forward your complaint to ETDA.
(d) In general, THAI has no dispute resolution processes, i.e., mediation or arbitration, in place. If THAI deems that those processes are necessary and beneficial in resolving any disputes, it may apply those processes to resolve disputes, as agreed.
6.11 Suitability of products, services or, content
(a) THAI is committed to presenting appropriate products, services, or content to you on the Platform, as required by law.
If THAI engages third parties to provide any services other than air transport services, such as travel insurance, please consider information or conditions prescribed by relevant operators or service providers.
(b) THAI uses its best efforts to set out measures to ensure that products, services, or content on the Platform are always appropriate. Therefore, THAI has established a mechanism to allow you to report any illegal product, service, or content, by logging into THAI's system, and submitting your comments or suggestions to THAI through the "Feedback" menu on the My THAI webpage. THAI will ask you to provide report-related details through its website, and to certify that the provided information is true.
In addition, THAI may request that you provide further information other than the contact information received from you (such as email address and telephone number) received from you when logging into its system, as follows:
1) a sufficient explanation of reasons to demonstrate how the product, service, or content in question violates relevant laws; and
2) details about the product, service, or content that is alleged by you to be illegal, and its location. The details must be provided
sufficiently, so that THAI can determine an appropriate action to the product, service, or content in question (such as a URL).
Upon receipt of your opinions or suggestions, THAI may notify any other service user who is alleged to have published the illegal product, service, or content to give him or her an opportunity to contest the allegation.
Applicable Law and Jurisdiction
The Terms of Use of this web site shall be govern by and construed in accordance with the Laws of the Kingdom of Thailand and the court of competent jurisdiction in Thailand will have exclusive jurisdiction in case of dispute.
